New Delhi, the ­­­­­23rd March, 2009

 

G.S.R. (E).- Whereas, in the matter of import of  all goods falling under tariff heading 7606 (Aluminium Flat Rolled Products) and all goods falling under tariff heading 7607 (Aluminium Foil), respectively of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the said Act), from People's Republic of China, the Director General (Safeguard), in preliminary findings vide number G.S.R. 65 (E), dated the 2nd  February, 2009, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), dated the 2nd  February, 2009, had come to the conclusion that increased imports of Aluminium Flat Rolled Products and Aluminium Foil into India from People's Republic of China had caused and threatened to cause market disruption to domestic industry of Aluminium Flat Rolled Products and Aluminium Foil and it necessitates the imposition of provisional safeguard duty on imports ofAluminium Flat Rolled Products and Aluminium Foil into India from People's Republic of China ;


            Now, therefore, in exercise of the powers conferred by sub-section (2) of section 8C of the said Act, read with rules 10 and 14 of the Customs Tariff (Transitional Product Specific Safeguard Duty) Rules, 2002, the Central Government after considering the said findings of the Director General (Safeguard), hereby imposes a safeguard duty:-

a)    at the rate of 21 per cent. ad valorem on all goods falling under heading 7606 (Aluminium Flat Rolled Products) of the First Schedule to the said Act, when imported into India from People's Republic of China; and

b)    at the rate of 35 per cent. ad valorem on all goods falling under heading 7607 (Aluminium Foil) of the First Schedule to the said Act, when imported into India from People's Republic of China.


2. The safeguard duty imposed under this notification shall be effective upto and inclusive of the 8th October, 2009 (unless revoked, superseded or amended earlier).
