Notification No. 85/2005-Customs

         Whereas, in the matter of import of Aniline, falling under sub-heading number 2921 41 of the first Schedule to the Customs Tariff Act, 1975 (51 of 1975), originating in or exported from Japan and United States of America, the Central Government had imposed anti-dumping duty vide notification number 128/2000-Customs, dated the 6th October, 2000, published in the Gazette of India, Extraordinary, number G.S.R. 772(E), dated the 6th October,2000;

          Whereas, the designated authority, vide notification number 15/2/2005-DGAD, published in the gazette of India, Extraordinary, Part-I, section 1, dated the 6th April, 2005, has initiated sunset review in the matter of continuation of anti-dumping duty on Aniline and has requested for suitable extension for levy of anti-dumping duty, pending the results of the review investigations;

           Now, therefore, in exercise of the powers conferred by sub-section (1) read with the second proviso to sub-section (5) and sub-section (6) of section 9A of the said Customs Tariff Act and rule 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the Central Government hereby makes the following amendments in the said notification of the Government of India, in the Ministry of Finance (Department of Revenue) No. 128/2000-Customs, dated the 6th October 2000, [G.S.R. 772(E), dated the 6th October,2000]  namely:-

         In the said notification, in Paragraph 2, for the words, and figures “with effect from the date of imposition of the provisional anti-dumping duty, i.e. the 10th April, 2000; and be paid in Indian currency”, the following shall be substituted, namely: -

   “  with effect from the date of imposition of provisional anti-dumping duty, i.e. the 10th day of April, 2000, and shall be effective up to and inclusive of the 9th day of April, 2006, and shall be paid in Indian currency”.
