Notification No.  99 /2005-Customs (N.T.)

 

          G.S.R.653 (E).- In exercise of the powers conferred by sub-section (2)  of section 146, of the  Customs  Act, 1962 (52of 1962), the Central  Board of Excise and Customs hereby makes the following regulations to amend the Customs House Agents Licensing Regulations, 2004, namely:-

 

1.(1) These regulations may be called the Customs House Agents Licensing ( First Amendment) Regulations, 2005.

 

   (2) They shall come into force on the  day of their publication in the Official Gazette.

 

2. In  the Customs House Agents Licensing Regulations, 2004,( hereinafter referred to as the said Regulation), -

 

 (i)  in  regulation 4, for the words “ two newspapers having circulation in the area of his jurisdiction ,” the words “ two newspapers, one in english and  the other in  vernacular language having wide circulation in the area of his jurisdiction, ” shall be substituted. ;

 

 (ii)  in regulation 5, in sub-regulation (1), for the  words and letter “ in Form A ”   the words and letter “ in the form of letter to the jurisdictional Commissioner of  Customs, containing details as specified in Form A” 

 

 (iii)  in  regulation 8, in sub-regulation (7), in the proviso,  the  words “ an additional or” shall be  omitted.; 

 

 (iv)     in  regulation 9,-

(a) in sub-regulation (3), for the words “ involved in” the words “ convicted of” shall be substituted.;
 

(b) after sub-regulation (6), the following  shall be inserted, namely;-

          “(6A) An appeal filed by an applicant under sub-regulation  (4) shall be decided by the Chief Commissioner of Customs or the Chief Commissioner of Customs and Central Excise, as the case may be, with in a period of  one year  from the date on which such appeal is filed.”

 

  (v)   in  regulation 10,  in sub-regulation(1), for the word and figures “ Rs. 50,000/ ” the word  and  figures “  Rs.75,000/-” shall be substituted. ;

 

  (vi)   in regulation 14, for the  words “ such change shall forthwith be communicated by such licensee to the Commissioner of Customs” the words “such change shall  be communicated by such licensee to the Commissioner of Customs within a period of sixty days of such change.” ;

  

                (vii)   in   Form A, for  the  heading  “Application  Form for  Grant of Customs   House Agent’s License under  section 146 of the Customs Act,1962.” the heading “ Particulars to be  Furnished for  Grant of Customs  House Agent’s License under  section 146 of the Customs Act,1962 ” shall be substituted.
