Authority of India (FSSAI) recently published a circular that makes
registrations for foreign food production facilities that export specific food
commodities, like meat, milk, and infant meals to India, essential. The new regulations
will take effect on February 1, 2023. The FSSAI (Imports) First Amendment
Regulations, 2021 will govern the registration process for foreign food
production facilities in five food categories that seek to export these items

In a recent circular, the Food
Safety and Standards Authority of India (FSSAI) made registrations for foreign
food manufacturing facilities that export certain food products, such meat,
milk, and infant formula, to India, mandatory. The updated rules will become
operative on February 1, 2023.
The registration procedure for
foreign food manufacturing facilities in five food categories that wish to
export these commodities to India would be governed by the Food Safety and
Standards (Imports) First Amendment Regulations, 2021, according to the
circular.
For the purpose of exporting goods
to India, such as milk and baby meals, the FSSA made registration with it a
requirement for foreign food manufacturing facilities.
In its ruling, the FSSAI demanded
that exporting nations' authorities give a list of current manufacturers and
those who seek to export certain food products to India. Following that, the
FSSAI would register such facilities in its portal based on the list submitted
by the relevant authorities.
The Food Safety and Standards Act,
2006, a consolidated act pertaining to food safety and regulation in India,
established the FSSAI as a statutory agency.
In November 2021, it gave notice of
the Food Safety and Standards (Import) First Amendment Regulations, 2021, which
went into effect on June 1 of the following year.
The procedure for registering
foreign food manufacturing facilities for the purpose of exporting to India is
outlined in the amendment policy as follows.
The following five kinds of food manufacturing facilities that export to India will be required to register:
Before exporting to India, foreign
food production facilities that come under certain categories and want to
export such food goods must register with the Food Authority.
The foreign food production plant
may submit an application for registration in "Form 16" of these
regulations along with the supporting documentation listed in Annexure-1 and
the applicable fee.
The FSSAI has requested all
competent authorities of exporting foreign countries to render the list of
existing manufacturers and those who intend to export these food products to
India.
The applicant will be advised to
provide any further information requested by the FSSAI upon review of the
application or to complete the application, as applicable, within 30 days of
receiving this notification if the application is incomplete. The application
for registration of a foreign food manufacturing facility will be refused if
the applicant does not provide the necessary information within the allotted
30-day period.
Further, on receipt of a complete
application, including the additional data if asked, the FSSAI may process the
application for inspection and issue registration or rejection of the
application.
